All references to "we", "us" and "our" shall be deemed to be references to H&T Thirsk Limited. and references to "you" and "your" shall be deemed to be references to persons placing an order via this website.
The following terms and conditions apply to all use of the H&T Thirsk Limited website. By placing an order with us you agree to have read, understood and accepted to these terms and conditions. Please note, as these may be subject to change at any time without notice, it is your responsibility to check this page prior to any use or purchase. If you have any queries regarding our terms and conditions, please contact us before use or order placement.
If you do not agree to any change to the Terms and Conditions, then you must immediately stop using the Site.
ORDERS
All orders are subject to acceptance and availability.
When placing an order, you agree that all details you provide to www.humphreyandtilly.co.uk for the purpose of purchasing goods are accurate and complete in all respects.
The price and availability of goods are subject to change without notice. Your contract for purchases made through www.humphreyandtilly.co.uk is with H&T Thirsk Ltd and you undertake that all goods ordered by you are for your own private and domestic use only and are not to be resold.
By placing an order via this website, you are making an offer to Humphrey and Tilly to purchase the goods detailed in your order upon the terms described, at which point your payment card or Paypal account will be pre-authorised.
You certify that the payment method you are using is your own and that there are sufficient funds in your account to cover payment of the product/s ordered.
Where a Gift Card has been used as payment, the balance will be debited at the point of order placement.
If any product from your order is unavailable, we will contact you either by email or phone, then attempt to fulfil your order from store and confirm details of any cancellation made where fulfilment has not been possible.
We are unable to make amendments to an order after the point of despatch. Should you wish to make any changes prior to despatch, please contact our Customer Services team via email; info@humphreyandtilly.co.uk pr by phone on 01845 527120.
It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will have their details passed onto the Police.
ACCEPTANCE OF YOUR ORDER
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order.
After placing an order, you will receive an e-mail from us (sent to the email address that you have provided when placing your order) acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm acceptance of an order from you by sending you an e-mail that confirms that the product has been dispatched (the “Dispatch Confirmation”). The contract between us (the “Contract”) will only be formed when we send you the dispatch confirmation.
Upon placement of your order, payment will be taken from your credit/debit card. If, for whatever reason, we are unable to fulfil the order, the payment will be refunded to you immediately. No contract for the sale of any product will exist between you and H&T Thirsk Limited until we accept your order by dispatching the product to you. When this happens, we will confirm the acceptance by sending you an email.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set-out above.
Furthermore, we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold; removing, screening or editing any materials or content on the Site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
YOUR RIGHT TO CANCEL
Under the Distance Selling Regulations, UK consumers have the legal right to cancel their order within 7 working days of receipt of the goods. For details of how to exercise this right please see our Returns Policy.
PAYMENT & SECURITY
We accept online payment in a secure environment by credit or debit card. We currently accept Mastercard, Visa, Delta, Maestro and Paypal.
All credit card details are encrypted to safeguard your details and no details are saved on any website which is why the payment is processed immediately when the order is placed.
All prices quoted on this website are shown in pounds sterling (£), and are accurate at the time of publication, and where appropriate are inclusive of UK sales tax (VAT) at the current rate.
You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Humphrey and Tilly, we will not be liable for any delay or non-delivery.
SECURITY CHECKS
In an effort to protect our customers, all orders placed at www.humphreyandtilly.co.uk are screened and security checked for fraud. We advise you to include a valid telephone number and email address with your order so we can contact you if we need you to confirm its authenticity. All checks are made for the security and safe shopping of our customers. We may ask you to confirm certain elements of your order which may include the billing or delivery address. We will never ask you for full credit / debit card details. Although it is rare that it would be necessary for us to cancel an order, we reserve the right to refuse any orders from a customer where the following situations are applicable:
- Incorrect credit/debit card number, expiration date or security code.
- Incorrect billing information (billing information you provide is different from information your credit card company/ bank has on record).
- Insufficient/incorrect shipping address (street, town/city, county or postal code).
- Fraudulent information.

Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations.
